Our recent client success story
Our client received a section 78 notice from the workers compensation insurer stating that their weekly payments of compensation would cease based on an assessment which found that our client could earn more in suitable employment than they were earning in their pre-injury job.
We were successful in arguing that they did not have capacity to work in the role identified by the insurer as suitable employment due to their injury as well as not having the required education, skills and work experience. Based on our submissions the insurer agreed to continue to pay weekly benefits. This also led to providing advice about other entitlements and they were paid lump sum compensation for permanent impairment.
In another recent case, our client suffered serious psychological injury during the course of their employment, they were advised by another firm that a claim for damages had limited prospects of success and would at best involve significant compromise. We took over the file and acted on their behalf in work injury damages claim and were able to resolve the claim for well in excess of the figures advised by their former solicitors.

Kerri is passionate about building strong relationships with her clients, and applying her wealth of legal knowledge to individual client situations to help them understand their legal rights. Kerri attended the University of Newcastle, where she graduated with Honours from a dual Bachelor degree in Laws and Business. During her studies, Kerri gained experience working at the Newcastle University Community Legal Centre. And, whilst working in a national law firm for ten years, she developed specialised knowledge in personal injury law and extensive experience with the Courts.

Gemma is a real people-person with a genuine passion and desire to ensure people are treated fairly. Gemma enjoys meeting new clients, listening to their story, and applying the law to offer solutions and peace of mind. Gemma graduated with Honours from a dual Arts/Law degree in 2006, spending some time in the United Kingdom focussing on international human rights. Following her studies, Gemma worked for a national law firm based in Sydney and Newcastle for over ten years where she specialised in personal injury work. In 2012 Gemma was recognised by the NSW Law Society as an Accredited Specialist in the area of Personal Injury Law.

Grants and costs
The Independent Legal Assistance and Review Service (ILARS) provides injured workers in NSW with access to free legal advice from approved lawyers.
Kerri and Gemma are IRO approved lawyers and can make an application for an ILARS grant to provide advice regarding your rights and entitlements, where there is a disagreement with insurers regarding entitlements or where assistance is needed to make a claim.
The grant of funding covers both legal fees and disbursements which means you do not have to pay anything to receive legal advice. Disbursements are expenses payable to a third party – such as doctors report fees, payment for clinical notes.
